Am I eligible for removal from the Sex Offender Registry?

See which of these situations applies to your case before requesting termination from the Registry.

  1. I am only on Tennessee’s Sex Offender Registry because I am required to register in another state. (Not sure? Ask your registering agency).

    ANSWER: You can be removed from Tennessee’s Sex Offender Registry either through removal from the other state’s Registry, or by following Tennessee’s removal process set out in Question #3.

  2. I have a statutory rape conviction (or its equivalent in another jurisdiction).

    ANSWER: If there was less than a 10-year age difference between you and your victim at the time of the offense, and your crime equates to statutory rape, you may apply now for removal from the Registry. (Statutory rape in Tennessee is consensual penetration involving one party who is 18 years of age or older and another party who is under the age of 18 and at least 4 years younger than the person who is an adult).

  3. I have a conviction that is classified as “sexual”.

    ANSWER: You are eligible for removal if it has been 10 years since the expiration of your sentence AND you have been registered in Tennessee for at least 5 years. (Choose the later date).

  4. I have a conviction that is classified as “violent”.

    ANSWER: You are not eligible for removal from Tennessee’s Registry.

  5. I have more than one conviction for a sexual offense (one offense was adjudicated and then another was committed with eventual conviction).

    ANSWER: You are not eligible for removal from Tennessee’s Registry.

  6. My offense was adjudicated in juvenile court.

    ANSWER: You may apply for removal if you have reached the age of 25 and have not been convicted of any subsequent qualifying adult crimes or adjudicated for any subsequent qualifying juvenile crimes.

  7. I do not fit the criteria for the Registry, but was placed on the Registry pursuant to a court order.

    ANSWER: Once you are no longer under the auspices of the court on this sentence (your sentence has expired), ask your probation/parole officer to notify TBI or your registering agency for removal. If you do not have a probation/parole officer, please notify the hotline that your sentence has expired. Be prepared to provide proof.

  8. My conviction has been overturned; my guilty plea has been withdrawn; my petition for post-conviction relief has been successful, or my conviction has been vacated for any other reason.

    ANSWER: Ask your attorney to notify TBI or your registering agency. Be prepared to provide proof.

  9. My conviction has been expunged in Tennessee.

    ANSWER: Ask your attorney to notify TBI or your registering agency. Be prepared to provide proof.

  10. My conviction has been expunged in another jurisdiction.

    ANSWER: Notify your registering agency or TBI; however, if you remain on another state’s Registry, you will still be required to register in Tennessee.

It appears I am eligible for termination from the Registry. Now what?

File a written request (in the form of a letter) for termination of registration requirements to: TBI Sex Offender Registry Unit 901 R.S. Gass Boulevard Nashville, TN 37216 Your letter to TBI shall contain the following text: “Please consider me for termination from the Tennessee Sex Offender Registry” (and nothing further). This letter shall also contain the date of the letter, the offender’s name, date of birth TOMIS/SO# (if known), and address. The offender shall both legibly print and sign his name at the bottom of the letter.


What about termination for those on the Registry for juvenile offenses?

Offenders classified on the Tennessee Sex Offender Registry (SOR) as “Violent Juvenile Sexual Offenders” may apply for termination from the SOR if they meet the following criteria:

  1. Must have reached the age of twenty-five (25); and

  2. Must not have been adjudicated delinquent or convicted of a subsequent qualifying offense as set out in T.C.A., § 40-39-202(20), T.C.A., § 40-39-202(28), or T.C.A., § 40-39-202(30) or its equivalent from another jurisdiction.

Offenders with juvenile offenses shall file a letter with an accompanying affidivait for termination of registration requirements to:

Juvenile Termination Affidavit

The letter shall contain the date, the offender’s name, date of birth, TOMIS/SO# (if known), and address. The Juvenile Termination Affidavit shall accompany the letter and must be duly signed and sworn for consideration.
